The degree of their unpreparedness, and their inability to concoct a story that hangs together in ANY particular would indicate that they fully expected Kilmar Abrego García simply to be gone and never ever reappear. I appreciate the sentiment. But referring officials for criminal contempt to a DoJ that won’t ever prosecute them might do more to undermine our system. And most of these would be criminal contempt questions, because there isn’t much by way of civil contempt left to apply. It’s a very dicey situation, and the record must be unassailable. Boasberg also faces the problem that this Supreme Court might view his request to employ a third party to prosecute the contempt as exceeding his Article III authority, the rules be damned. No easy solution here.

I’m a retired city police officer and most officers are in fact polite, professional, respectful and take their oath to protect and serve seriously. Those officers who behave differently are usually met with the consequences from the department’s internal affairs department.
