Both Judge Lewis Kaplan and E. Jean's chief counsel Roberta Kaplan (no relation, but they think alike!) have absolutely torched tRump and his low-budget lawyers repeatedly, and it's no surprise that Judge Kaplan issued a summary judgment in Carroll I , and left the trial jury next January just with the dollar amount to settle damages...yowzah!

Yesterday, six Republican and unaffiliated Colorado voters sued the Colorado Secretary of State and former president Trump to keep him off the 2024 ballot based on Section 3 of the 14th Ammendment.

About ten days ago, I wrote to Jenna Griswold, Secretary of State here in Colorado, seeking her to bar TFG from the ballot under the 14th Amendment. I included references to the case made by conservative republicans and how the New Mexico, Otero County Commissioner, Griffin was removed from office and disqualified from the ballot.

Her reply:

“Thank you for your email. As of today, our office has not received paperwork from former President Trump or any other candidate seeking to access the 2024 ballot. Until that paperwork is received, our office cannot make any determinations regarding the eligibility or ineligibility of any candidate to appear on the ballot. If you have any further questions, please feel free to contact us again.”

Perhaps Jenna is taking cover for now on the ballot issue (note she is a Democrat, as is our Governor and Attorney General). Given what I know and perceive about Jenna, I suspect she is giving serious thought to the 14th Amendment.

QUESTION: Can the case to keep him from the ballot proceed without him applying to be on the ballot? Or can it move forward anyway?

I'm in Colorado, too, and am thrilled that Colorado is willing to be the test case for this. I think this is the first time a Colorado Republican has done anything truly worthwhile for the state. Despite Ms. Griswold's statement, this at least has time to work its way through the courts before the election. However, I don't have much hope for a favorable outcome unless there have been some convictions for Trump in the meanwhile. I hope I'm wrong about that.

question - do all courts allow the weight and height to be self given rather than measurments taken by the court? In other words why was Trump allowed to give a weight so clearly too low

I’m an original Star Trek aficionado only. I know. I’ve heard it from many Trekkies that I must watch all the other spinoffs , but no, I am a devoted Original Star Trek guru! I watch one or two episodes a night and yes I can quote verbatim the dialogue, which is impressive to those that don’t watch as much as I do. I love the article Jay! I am feeling anxious as we get closer to 2024. My hope is the 14th amendment can be used. I am also waiting in anticipation for the next big thing Trump tries to pull. There will be something. I am never surprised. I hope you feel better! Watch Star Trek! Last night I watched The Man Trap and For The World is Hollow and I Have Touched the Sky.

Thx for this, Jay - clear, crisp, entertaining, and informative.

Question - it seems obvious that trump would not be granted a security clearance based on his reckless theft and custody of confidential documents. How could he serve as President & Commander-in-chief without security clearances? Seemed this render him unfit for those roles.

This reason independent of 14A-3 disqualification issue of insurrection activity after violating oath of office. Any thoughts appreciated?

I believe, though I’d need to consult an expert, that the president automatically qualifies for security clearance of the highest level. No one has to grant him that as the voters already have.

Wow Jay- that sounds crazy! Even now he is still saying in interviews that he had the right to take and keep whatever documents he wanted (based on the Presidential Records Act! LOL). And throughout his term he was careless and reckless with "America's secrets," in the words of security/military.

Very risky, I think.
