The New York Times reported yesterday that not only did former President Trump take some 15 boxes of presidential archives with him to Mar-a-Lago, but that some of the documents actually contained classified information.
In my mind there is a HUGE difference between walking out with classified documents and walking out with gifts. I can see how someone would think they could keep a "gift" but walking out with information that was clearly classified should not even be on someone's radar as "ok to keep". But it is trump who lacks any kind of logical brain. Sad that we have all these laws yet we can't get him on any of it.
For every law that the Republicans refuse to support is the possibility it can be abused by those currently in office now. It's obvious that Biden would never abuse his office or flout the laws as tRump did, but if the Republicans are refusing to shore up the laws' penalties and punishments so that the next Republicans in office can abuse their office, then it stands to reason that Dems can do it, too. What's good for the goose is good for the gander. No?
Yes, that would make 'us' just as bad as 'them,' but it's time that the Democrats stop acting like the lilywhites and do what's necessary to make this an even playing field. It's obvious the Republicans are refusing to observe any decency, and will play as dirty as they can as long as it means staying in (or regaining) power so that they can continue destroying what's left of this country and our democracy. If the Democrats allow this nonsense to continue unabated, we're doomed. That much is clear.
As you suggested, these violations "are best understood as part of multiple violations of other laws and rules—the Emoluments clause, Hatch Act violations, blatant conflicts of interest, outright self-dealing with his hotel properties—that are on their face illegal but, as we discovered, nearly impossible to enforce against a sitting president . . . " But 1) he is no longer a sitting president, and 2) these brazen violations - particularly tearing up documents and taking classified documents - along with the recent revelations of unaccounted for phone calls during the Capitol insurrection (which were likely on *trump's personal, and quite possibly burner phones) contribute heavily to a pattern of criminally conspiratorial and obstructionist behavior. The preponderance of evidence becomes more astounding every day. When will the other damned shoe finally drop?
A couple of observations, if not full legal anaysis. The National Archives has a superior Fraud/Inspector General Unit probably better staffed than DOJ do this work. Second, the PRA has a legislative history & a regulatory pattern of practice decades-long that TFG says he gets along with. Regs are important particularly if anyone claims the PRA is not self executing. The mishandling of classified/ national security documents is an entirely different enforcement framework with substantial case law to point the way.
If everybody wasn't so afraid of tRump, he'd have been behind bars by now. And for those who are saying 'of WHAT???' then perhaps it would be wise to look into the backgrounds of those in the Republican party who are toeing his line, backing him without question, and allowing him to blatantly break all these laws. What does he have on them, exactly, and why are they so afraid of him? Perhaps some investigating of those people might be a start.
Will this be the straw that broke the camels back I doubt it seems he was pretty much correct he is above the law. When will he ever be held accountable for his blatant criminality 🤬
