I am now singing “The cheese stands alone, the cheese stands alone, hi ho the derry -o, the cheese stands alone” from my childhood (from Wisconsin - Farmer In The Dell?)

HAHAHA!!! Now I'll be singing this all day. Thanks a lot. 😂😂

Laurence Tribe wrote a very scathing rebuttal to The Cheese's citation of Tribe's writing concerning the 1960 election results in HI, and how Kenny- boy completely misrepresented the original work. Cheese finds himself now permanently

on Tribe's shit-list for good reason...read it here:

https://www.justsecurity.org/87498/kenneth-chesebros-misrepresentation-of-laurence-tribe-scholarship-in-his-efforts-to-overturn-the-2020-presidential-election/

Also, amongst his "defense" against the charges in the Willis indictment was that he was offering "options" in orchestrating the fake-elector scheme in GA and other states, sort of just - you know - "spitballing" various strategies, potentially illegal ones at that, and that the tRump campaign was free to ignore his machinations. Cheese was just putting shit out there, and it was for others to determine whether to use it, or to sort out the legalities. Nice try, bro, won't fly.

In furtherance, admits also to drafting the fake elector certificates based on the real 2016 ones. Remember the reference to "the spear on the ground"? I am wondering now if the "signaling" referred to is related to a video I stumbled across on J6 where a bearded man (not Tarrio or Rhodes) described a WH meeting where they discussed a contingency plan "where we come in" if their other plan (Pence) didn't work out. Hmm "could appear treasonous.” Yes, it sure does, all of it does, IMO.

Between his now horrifically compromised former Harvard Law prof colleague, Dershowitz, and the Cheese-Bro, Tribe must be wondering what the hell happened to these brainy "friends" from back in the day.

Brilliant. You are one of my favorite bloggers as you deliver so much reasoned analysis and astutely ferreted out facts and you get your pieces out so quickly (do you actually sleep?) without the unnecessary drama that some writers engage in. Kudos

Thank you for this kind note. I do sleep each night around 7 hours! I just go to bed quite early, and prefer to rise before dawn.

I agree with Liza. I don't know how you find enough hours every day, AND get enough sleep, to write as much as you do keeping us all informed. I believe I 'found' you through Dr. Richardson's LFAA posts and am so very thankful for your excellent writing. I consider you a national treasure!

As his sister, I’m proud to say that a) Jay does sleep and b) he’s always been incredibly gifted at processing, interpreting and communicating at warp speed. He inherited his analytical side from my dad, who was a trained engineer but really just a deep thinker and inventor. And my mom gave him his gift with language; she was a prolific writer. Her high school friends described her as always writing and always giggling-- that’s pretty true of Jay (the giggling part, too!). In high school, I remember how Jay wrote an essay for an Academic Decathlon competition that was flawless and scored him 100%. As a young lawyer, he would typically leave the office at 6pm with his briefs completed and needing little to no revisions. And now he’s really hitting his stride by providing a hugely valuable service, based completely on the donations, support and generosity of others, and mostly enjoying it! Needless to say, im incredibly proud but also not at all surprised by his abilities. He rocks!!

This is such a lovely comment, Mimi. Thank you!

Had the Cheese gone to UT-Austin for law school rather than Harvard, would would probably wound up in a corner office at Enron, with all the other greedy guys who thought they were “the smartest in the room”.

Thanks for helping me understand who this person is. I still don't understand and can't explain his motivations, but at least I have a more complete background and context.

I expected someone to try the speedy trial, just as I expected Meadows and Clark to try to move to Federal Court. 19 defendants to probe for every weakness.

But it does seem as if Fulton County has prepared for multiple challenges and is ready to proceed.

Fascinating! Thanks for the deep dive. It’s essential to shed more light on all of these odious characters, their motivations, contradictions and outright lies.

When the movie is released, the person playing Princess Leia/General Organa will be Fani Willis, bringing her Jedi force with her!

I'm fascinated how people 'switch sides' or allegiances so seemingly easily. Yes, perhaps crypto and greed. Opportunism? I question values developed over years that change. Is that more common than I knew since mine haven't nor did those of my parents (z"l) and of those to whom I'm closest.

I do not envy the people of Atlanta who will deal with the brouhaha of all this.

Thanks for such a deep dive into Cheese-Man-he was such an unknown until now. The breadth of people who have fallen into the Trump Trap is pretty incredible. I've stated before that a study should be conducted on those who adore and condone inmate P01135809. I bet they find some mutant gene or damaged DNA that contributes to their gullibility. History will not be kind. Another GREAT write up, Jay. We appreciate you! 👍

On the wake of The Cheese’s motion for an early trial and Ms. Willis’ motion to begin the trial for all 19 defendants, at least one of the fake electors, David Shafer, the former GA GOP chairman, has moved for his case to be removed to federal court on the grounds that he was a “federal official” acting at the direction of the President.

Mr. Shaffer’s motion seems to have two flaws:

1) The Constitution says that “Each State shall appoint... a Number of Electors” to vote for President and Vice President. This seems to imply that they are STATE officials acting on behalf of the State and therefore not federal officials.

2) Mr. Shafer, et.al., were in fact FALSE electors acting on the advice of The Cheese and other conspirators in the Trump Campaign, and not on behalf of the State of Georgia, which, after multiple recounts, had certified Mr. Biden as the rightful winner. Ergo, they were hardly acting “under color of law.”

I’m willing to be corrected if I’m wrong.

These are two good arguments, and there are others. The president himself has no authority over the elections, which are run by the states, and so he can’t have been ordering people to do things under color of law on his behalf as president. At best he can claim he was asking them to do things as candidate Trump, but that isn’t acting under federal office.

What a slimy worm..

Wow! The interesting question is why he took that "sharp turn to the right." Was he feeling underappreciated (though he seems to have chosen the role of sole practitioner) and resentful of that? The BitCoin story could give a clue--a calculation that throwing his lot with the gullible following trump would result in a faster rise to fame than anything else.

I'm cynical, but for people like The Cheese, I always think it's about power. Perhaps, with all his new found wealth, he decided this was the way to get power. We'll probably never know.

Expand full comment

that, I think, is my point. Observe the rise of the gullible, decide that they are the road to power, reason or principles be damned.

This. That siren song has led astray stronger and more principled folks than these.

I found myself wondering about that hard right turn too. Perhaps something financially shady is buried in the "crypto" gain figures? The timing is suspicious, to say the least. Did someone put him on a financial leash, either bankrolling him or blackmailing him?

I'm not willing to go full on conspiracy. I AM thinking the monetary calculation and the political calculation of risk come from the same source.

It will be interesting to see how Cheseboro’s legal strategy plays out. I lean toward a combo of legal bravado/underestimating Willis & worry about further charges as motivation. He is a fascinating character in this craziness.
