When in doubt about the reasoning behind rulings, follow the money. And in the case of the Roberts Court also follow the gifts, international luxury trips, free rent, luxury trailer homes, shady property deals...
How billionaires bought the Supreme Court for Trump to pack Federal agencies
SCOTUS reform NOW!! When the Justices acknowledge *themselves* that their same-day rulings create “a tension”, there’s a problem with the court. And it all comes down to MONEY and GREED and placating billionaires. I’m sorry, but this is unacceptable. What can we do when (🤞🤞🤞🤞🙏🙏🙏🙏) we win in November??
Ms. Slaughter said it so wisely: “Somehow Wall Street is special and gets special treatment, but other than that, the agencies that look out for everyday Americans do not,” she declared.”
We everyday Americans must RESIST and RESIST HARD when we vote this year!!
There's no way to reform your supine court now, and it's probably not a good idea: if the people win a case, it gives Trump a map on how to defeat it next time. And there will be a next time. Best to wait for the chance to make it foolproof.
Good point. But I still believe action is warranted - waiting won’t make the issue go away. Come November, we must try. Right now, think tanks should explore ways to make foolproof changes, changes that are fair to the country and take the politics and money incentives out of the SCOTUS - these conservative Justices get so many perks from the moneyed rightwing and corps, their allegiance to the Constitution and the country is clearly compromised. I’d think one rule could be no more yachting excursions and luxury vacations unless the Justices use their own money. And no kickbacks.
It’s not radical, what I’m thinking, but the money influence must be removed and the Justices’ personal spending tracked.
Quid pro quo is NOT in the interest of the American people or compatible with upholding the Constitution.
I agree with all of this, Wis. What I should have said is to first ensure you GOTV and win in November, then try again to muzzle this court. There's a rumour Alito is retiring soon, so if his replacement can be stalled, perhaps there's a chance Trump won't be able to name that replacement.
Yes, I was a bit misleading with using the word “NOW” in my initial comment. It wouldn’t be possible, feasible or prudent to try reform immediately, like, tomorrow morning. Once we get some power back come November (God willing!), SCOTUS reform does need to be a high priority, and we need to anticipate the changes we want to see happen.
Sigh: EVERYthing needs to be a high priority! Trump has ruined SOOOO much!
Democrats need to run on the economy, corruption, and the need to reform the SC. Term limits need to be put in place, and made retroactive, and the court needs to be enlarged. Having a SC that is making decisions based on political ideology is pure evil.
One of the anti-federalist objections to the Constitution was that the separation of powers was not clear-cut. For example, Congress had to approve executive appointments. The authors of”The Federalist” replied that the Constitution had been designed so that no branch could do its job without the cooperation of the ethers. This was a deliberate defense against tyranny. The unitary Executive principle goes directly against that principle.
There is no way that I will understand and accept that appointment requires confirmation but removal does not. Whatever else Roberts is, he will be known as the chief of a rinky dink court
It's very frustrating that our supposed separation of powers/"three distinct, co-equal branches to prevent autocratic rule and protect individual liberties" have been collapsed into ONE unit, all led by this president.
Legal claptrap is to be expected from a court that has long since lost its legitimacy by allowing corrupt judges to serve by not having an enforceable ethics code. It’s one thing to be intellectually mistaken, quite another to be bought and paid for.
I guess this absolutely is taking his quote out of context, but Gorsuch sure provided the perfect summation of both the Roberts Court and our current times when he said, "The ability to judge disputes in-house remains, but now the house is white."
Also, nice obscure reference to "Roberts Rules of Order."
Seems to me that this SCOTUS is beholden first and foremost to the billionaire and capitalist class (of which Trump happens to be part of). It's why they rejected many of Biden's initiatives that would have hurt capitalists but approve of Trump's moves to strengthen and protect them.
Once again, the Roberts' Kangaroo court is proving to be stacked with a gaggle of unqualified partisan hacks. The GQP6 are a disgrace and deserve endless mockery and disrespect.
Exactly - and never forget that three would be justices told the American people during their Senate confirmation hearings that they would respect Stare Decisis. They lied during their Senate confirmation hearings. It’s on tape.
Supreme Court reform needs to be a part of any democratic platform.
You are correct-We have a court that is corrupt , racist and political-It ignores our constitution and laws -
The only answer is if democrats win 2028 they need to expand the court , have term limits and a code of ethics not written by the justices-
These justices are traitors to our country-

Roberts will be remembered as a very terrible part in history.
His court legacy will be driving a stake into the heart of our democratic republic.
He'll be in good company..

Let's face it: Unitary Executive actually means Authoritarian Leader. And the court is okay with that.
There is no way that I will understand and accept that appointment requires confirmation but removal does not. Whatever else Roberts is, he will be known as the chief of a rinky dink court
Now that Trump has full power, he can do away with the confirmation requirement too. It only follows. Who thought a kakistocracy could get worse?

Frustrating? You're living in a full-blown dictatorship now.

Hopefully the next Democratic President cleans house and show the Republicans how the law works both ways
Yes, but then you get a never-ending cycle that leads to instability. I wish I knew what the answer is.

White, in more ways than one.

Corrupt scum.
This is an outstanding all-round post, but the line about the Slaughter House Six is sublime.
RIP Stare Decisis.

In 2029 when there is a Democrat in the Whitehouse these decisions will come in very handy.
1) FCC- pull Fox News broadcast license. Just because
2)Fast track “lock them up”
3)Executive Orders under ‘National security authority -major wealth tax.
4) pull fossil fuel subsidies
5) election security
