Thanks so much for the analysis. You make things easy to understand and help relieve my mind that he might some day soon be actually charged and hopefully convicted. I look forward to your analysis of the other two recommendations from the committee, especially since I saw an article on MSNBC that said that the insurrection charges won't stick. I also wish you and your family well, and sorry for your loss of Ma.
Thanks for the breakdown, Jay. On the Jan. 6 charges, I don't believe anything will stick on Trump to land him in jail. He is really good at not getting caught. 2 things I see, his defense will shred any witness's credibility and he has minions that will fall on the sword in exchange for whatever he can give them or their family (like his former CFO).
I'm much more confident that the stolen documents will get him in much hotter water.
I would love to see him in jail for the rest of his life. I am praying that he gets banned from ever holding any government office again.
The statute says that, true, but it’s not clear that a ban on holding office that was drafted by Congress can be applied to the head of a co-equal branch of government. It’s an unanswered question that raises separation of powers questions.
TIMONTHY J. HEAPHY is another brilliant professor, Law Professor & former white collar defense lawyer; Tim has been there (in the courtroom) on complex cases.
An excellent synopsis that helps me see it all more clearly....thank you for your excellent work. And my sincere sympathy to you and your family for the loss of your mother.
Interesting, thank yo for the update and the rundown of possibilities. I remain hopeful the justice will be served and we will see the TIFDG finally pay for his criminality.
Agree! There may be light at the end of this seemingly impenetrable Trump tunnel. Thanks so much for your clear analysis. Eager to read your take on other 3 possible charges.
Those “willing to fall on their sword” for TFG, must know that his promises are not going to come to fruition. Once their testimony is made and they are sentenced, changing their testimony would only make their personal predicament worse. Trump has no real incentive to keep any promises he makes and certainly no history of doing so. Protecting Trump would be hitching themselves to a flaming wagon, going over a cliff. Even his own family members are distancing themselves.
Logically makes sense...so why did his CFO fall on the sword then? Was it payment for TFG "helping" him all these years before he got caught or will TFG take care of his "family". As we find out more details, TFG is acting like he's in the mafia.
"In sum, the fact that Trump, Meadows and Giuliani organized, promoted, and continued to back a blatantly fake elector scheme, all the way up to January 6, makes them guilty of a conspiracy to obstruct and defraud the U.S., and they appear to be without any obvious defenses to this."
My nagging question is what does he have on these people that makes them willing to throw themselves on the sword for someone who has proven time and again he is not worthy of such loyalty?

A conviction in the "stolen documents" case does inlcude a permanent bar from holding "any office".

True but, multiple strategies available ... not only litigation.
Exactly

Thank you for your insightful analysis. I hope they nail him. I'll look foward to more of your breakdowns of the Committee report.
Fabulous summary and analysis! You make a complicated legal case more understandable and clear, thank you!!! Love you, Jo.
Thank you for assuaging my fears. I now have some hope. They must pay a price for what they’ve done or others will not hesitate to try. 👍🤞🙏🤞
Amen to that. The reason Trump got so bold is that we allowed Bush and Cheney to get away with their, arguably much worse, war crimes.
Thank you. This is great news!
Thank you-just thank you!

Excellent analysis. Thank you.
I’m not sure one can have a headache like I have after reading this but I have a happy headache!
