Where are the "originalists" when you need them? Clearly, the original text of the Second Amendment refers to a militia and the need for a militia to be armed.

In the 1790s the only 'arms' were matchlocks and flintlocks. No revolvers, machine guns, assault weapons, etc. No brass bullets. No 30 round magazines.

The 'regulated militia' has been replaced by the National Guard.

"DAVIES: You know, the Second Amendment was crafted after the constitutional convention as part of the Bill of Rights. And it, of course, talks about a right to bear arms. It also deals directly with militias, particularly state militias. How is this an expression of racism in its day?

ANDERSON: It was in response to the concerns coming out of the Virginia ratification convention for the Constitution, led by Patrick Henry and George Mason, that a militia that was controlled solely by the federal government would not be there to protect the slave owners from a enslaved uprising. And it was the way that James Madison crafted that language in order to mollify the concerns coming out of Virginia and the anti-Federalists, that they would still have full control over their state militias. And those militias were used in order to quell slave revolts."

After reading this could it be argued that the Second Amendment is means nothing? Using 'originalism' the 'arms' in use in the 1790s no longer are used for warfare. And the regulated Militia has been replaced with the National Guard. The reason for the Second Amendment was to allow the southern states to have their 'slave patrols' and now there are no more slaves,

The relatively recent proliferation of local "self-defense" organizations calling themselves militias was largely motivated by the perception that this would protect them against the government "coming after" their guns. The fact that militias, as understood in the 18th century, are now functionally supplanted by a Department of Defense, a multi-branched standing military with their own reserves, and a National Guard in each state, as well as State Police forces in every state, renders these tiny private militias both superfluous and ludicrous. They are a sham intended to skirt the 2nd amendment because they know full well that their other arguments have nothing to do with the original intentions of the framers. Unfortunately, some of our 21sr century Supreme Court justices - and most brazenly and ironically, those who self-identify as originalists - have set new precedents that have had shockingly tragic consequences. So, if by some miracle Congress were to take meaningful legislative action, I'm not so sure their efforts would not be struck down by these partisan dunderheads.

Re the Latest Texas Massacre, NYT & other media are trying to pinpoint the Timeline after the 18 year old Shooter arrived at the elementary school & crashed his car. UPDATE: Per NYT's 4 authors on a LIVE feed, at exactly 11:30 am Uvalde time, a 911 call alerted local police that a "truck had crashed"and a man was reported to have left the crash with a "long rifle & a backpack". Hmmm? ABC News reports the Shooter arrived at the school at 11:32 am.

There was, in fact, an armed confontation with a "armed redources [school] officer "exchanging shots". ABC News reports there was an exchange with School Officers (plural). The Active Shooter with no body armour entered Robb Elementary School through the "south" door. There is video. Local police arrived in a few minutes. But, exactly when? How many? Did the School District Officer or Officers (plural) per ABC follow their target or back off? Please Identify the School "armed resources officers" personnwho confronted the Shooter at this very early stage.

The timeline needs further investigation by logging digital communications between and among the apparent four (4) or more police agencies involved including: (1) olive green shirted Sheriffs with patches on their uniform;(2) the "Texas Rangers" (DPSOA): (3) School District Officers; and (4) confoundingly, the U.S. Border Patrol. What ... Texans called the Feds? Yes, Texans called the Feds, the U.S. Border Patrol. Per ABC NEWS about 80 "assembled officers" had cornered the Shooter. Per ABC NEWS about about 40-60 minutes went by until the final fire fight. Updated: By NYT's Natasha Frost on 5/26 in the early a.m. reported a "protracted scene of carnage" ended ,"after 1 p.m." about 90 minutes.

i thought Abbott's Texas was on its way to being a separate country blocking international traffic or at least a "well organized militia". I guess Abbott's blocking of the international border traffic was just another fiasco. The state of New Mexico has moved right in to get that traffic for NM.

Waiting period anyone? Two weapons were purchased by an 18 year old in 3 days along with more than 375 rounds per ABC. Red Flag in Texas? Not if your color blind. All of this within week or so of the Shooter's 18th birthday?

As specified by Beto O'Rourke in Spanish & English, there have been at least 5 Massacres in Texas in recent history. "This one is on you!"! Time for immediate state (that means you Texas) and Federal action NOW. Remember ROBB ELEMENTARY SCHOOL!

Yes they claim to be pro- life but choose guns over the safety of the children already living so apparently once they are born they are free game and the no longer care about them or their safety or if they live in a back alley or they starve to death the GOP I are frauds on every level anyone who can stand behind their BS are no different frauds liars fascists and the Supreme Court who is supposed to leave opinion out of their decisions is now politically motivated we are on the verge of losing our democracy. The GOP has chosen guns over childrens lives that right there say it all.

Yes! Fraud is the correct word for what the Courts, Gun Lobby, Gun Nuts, and just enough of the electorate who claim: 'Its a shame- but nothing can be done" or " 'It's complicated" The Onion is doing it's part today to echo those clueless voices in superb fashion.

Great title!

It is not clear to me what else has to happen to open people's eyes to the reality of what is happening to America... The gun lobby feeding the less educated minds, the tech industry powerful enough to take action significant enough to amount to national policy... I find it fascinating how many people can be manipulated so easily by fear mongering lobbies. They think they read but they don't understand the concept of reading a variety of sources and the art of validating assumptions.

You don't need a permit to exercise the right to free speech in a public place. You're entirely free to simply enter any public space and make a speech. You need a permit to have a coordinated gathering due to the effect it would have on other people's access to the space, safety and security, etc.

And you got here because of ignorance, apathy, and money. Lack of cohesive education curriculum across the country that was well funded. Citizen apathy due to lack of understanding how any of the electoral or democratic systems work, and oodles of money poured into the pockets of “accessible” politicians, radio shows, news outlets, and media.

If you really don’t understand how things are supposed to work, and all the information you do get is incredibly skewed, you are not capable of seeing any other side but the one your being bombarded with.

Cutting educational budgets was a stupid move, and almost ever wealthy, democratic nation has done that over the last 20 years. And that makes for people who are easily manipulated by the information that do receive.
